Larry Nassar, the former USA Gymnastics and Michigan State University team doctor imprisoned for serial child sexual abuse, has been denied his motion to appeal his sentence.
Theres nothing Ive done that prejudices me on this case, Judge Rosemarie Aquilina told Nassars attorneys in court Friday morning. Your motion is denied.
Nassar and his attorneys filed a motion to appeal his sentence last week, claiming that Aquilina, who presided over Nassars first, widely covered sentence hearing in January, was biased against him. Also, he blamed Aquilina for a recent assault he said he endured at the hands of other inmates at the United States Penitentiary in Tucson, Arizona, where he is serving part of his sentence.
Aquilina sentenced Nassar to 40 to 175 years in prison on seven counts of child sexual abuse after a weeklong sentencing hearing during which 169 of his victims and victims and family members read powerful impact statements.
At this point, justice cannot be served in terms of the appearance of impropriety, Nassars attorney Malaika Ramsey-Heath said. Dr. Nassar has the right to continue this process. This case is not over. It did not end upon conviction. The appellate process must be allowed to take place.
Ramsey-Heath pointed to Aquilinas recent appearance at the ESPY Awards, her public support for sexual abuse survivors on her social media accounts and media interviews before the appeal process took place as evidence of her bias against Nassar.
Michigans chief deputy attorney general, Laura Moody, argued that Aquilina used strong but appropriate language throughout the January sentence hearing. She added that if Nassar was attacked in prison, its because hes a convicted child molester, not because of anything Aquilina said during sentencing.
